By using any service powered by Easy VIP Valet, including receiving SMS notifications or accessing a guest ticket page, you agree to these Terms & Conditions ("Terms"). If you do not agree, do not use our services.
Easy VIP Valet is a software-as-a-service (SaaS) platform that provides valet ticket management, SMS notification, and reporting technology to valet parking operators ("Operators"). Easy VIP Valet is not a valet parking company. We do not employ valet attendants, take possession of vehicles, or operate parking facilities. All valet parking services are performed by the independent Operator at the location where you parked.
By personally checking the optional SMS consent box at vehicle drop-off, you expressly consent to receive one transactional SMS from the valet operator, powered by Easy VIP Valet, related to that valet visit. Providing a phone number by itself does not constitute consent.
Easy VIP Valet provides technology only. The Operator — the valet parking company at the location where you used valet services — is solely responsible for:
Any claims related to vehicle damage, loss, or valet operations must be directed to the Operator, not to Easy VIP Valet.
Valet fees are set by and payable to the Operator. Payment processing may be facilitated through our platform using Stripe, Inc. as our payment processor. Easy VIP Valet does not set valet rates and is not responsible for pricing disputes. All payment disputes must be resolved with the Operator. Refund eligibility is determined by the Operator's policies.
THE EASY VIP VALET PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. SMS DELIVERY IS DEPENDENT ON THIRD-PARTY CARRIERS AND CANNOT BE GUARANTEED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EASY VIP VALET AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO EASY VIP VALET IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
You agree to indemnify, defend, and hold harmless Easy VIP Valet and its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of our services, your violation of these Terms, or your violation of any rights of another party.
All content, trademarks, software, and technology on the Easy VIP Valet platform are the property of Easy VIP Valet or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any part of our platform without prior written consent.
Your use of Easy VIP Valet is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services you agree to the collection and use of information as described in the Privacy Policy.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the state and federal courts located in Florida for the resolution of any disputes.
Before filing any legal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days. If the dispute is not resolved informally, both parties agree to submit to binding arbitration under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.
Class action waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.
We reserve the right to update these Terms at any time. We will post the revised Terms on this page with an updated effective date. Your continued use of our services after the effective date constitutes your acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
